Schoenberg Investments Escrow Service |
Note: Escrow services do not apply to London 2012 Schoenberg Investments (“SI”) is an Escrow and Payment Processing company (BC registered Corporation). SI has been chosen by Rent For The Games and VLR Management to oversee payment arrangements between Property Owners (“Owners”) and Visitors (“Occupants”). 1. User Identification All information provided to SI by all parties shall be true and accurate. Parties agree not to impersonate any person or entity or use a name or alias that is different from their legal name. SI reserves the right to cancel any transaction which is based on misleading or untrue information. 2. Party Conduct All parties are of legal age and are able to form legally binding contracts. Parties agree that their transaction does not violate any applicable laws or by-laws. Parties further agree that SI has the right to terminate or deny, at its sole discretion, any or all services. 3. Funds SI can accept payments in the following forms depending on transaction: Credit card, money order, cashier’s check, wire transfer or personal or business checks. Transactions will not be guaranteed until SI has verified that all funds have cleared. All funds will be kept in SI’s trust account with the North Shore Credit Union in Vancouver, BC. 4. Fees and charges SI collects fees from Owners and Occupants. Owners pay a flat $9.99 processing fee which will be deducted from the final payment upon execution and/or completion of the transaction. Occupant’s fee is calculated as 10% of all funds in trust for a maximum charge of $250. SI Fee is deducted from the final transaction. The final transaction in payment processing for Rent For The Games is the refund of Damage Deposit, therefore the SI Fee will be deducted from that payment. Should Damages exceed the amount of Damage Deposit, Occupant shall be billed directly by SI for the Escrow Fee 5. Unclaimed Funds Funds held in trust cannot be released without: (1) the mutual instructions of both parties; (2) performance or implementation of the policies set by Rent For The Games (3) an order resulting from arbitration or (4) a court order. Unclaimed funds will remain in escrow for a period of three (3) years. 6. Disclaimer No advice or information, whether oral or written, obtained by Parties from SI or through the Service shall create any warranty not expressly made herein. Users expressly agree that use of the Service is at Users' sole risk. SI expressly disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including, but not limited to merchantable warranties, fitness for a particular purpose and non-infringement. The Service is provided on an "as available" basis. SI makes no warranty that the Service will meet Users' requirements, or that the service will be uninterrupted, timely, secure or error free; nor does SI make any warranty as to the results that may be obtained from the use of the service, its accuracy, its reliability or that defects in the software will be corrected. 7. Additional Duties and Mediating for Rent For The Games SI agrees to be the third party and hold Damage Deposits in Escrow for the Occupant in rental transactions with the Owner. It is presumed that these funds will be returned to the Occupant upon completion of the rental experience-subject to Terms and Conditions contained in the Rental Agreement. As a condition of Service, SI reserves the right to issue final judgment in all claims, disputes and disagreements arising from or connected to Damage Deposit. SI reserves the right to issue final interpretation of the Rental Agreement. SI reserves the right to refuse any Damage Claims it deems suspicious or poorly documented. SI liability will at no time extend beyond the amount of funds held as Damage Deposit. 8. Any action relating to the terms of this agreement and those of the Rental Agreement shall be commenced and disposed of in British Columbia |
